Agreement to Terms

By accessing or using Recommander at recommander.cards (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

The Service is operated by Big Dumb Lizard LLC (“we,” “us,” or “our”).

Description of Service

Recommander is a free Magic: The Gathering Commander deck recommendation engine. The Service allows users to discover Commander decks, view deck analysis, and receive personalized recommendations. Registered users can vote on recommendations, save preferences, and access additional features.

Accounts

Registration

To access certain features, you must create an account by signing in with Discord. By creating an account, you:

  • Confirm that you are at least 13 years of age
  • Agree to provide accurate information
  • Agree to our collection and use of your data as described in our Privacy Policy
  • Agree that your voting activity and usage data will be used to improve our recommendations

Account Security

You are responsible for maintaining the security of your account. We are not liable for any loss or damage arising from unauthorized access to your account.

Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we determine, in our sole discretion, violates these Terms, is harmful to other users, or is otherwise objectionable. You may request deletion of your account by contacting us.

Acceptable Use

You agree not to:

  • Use automated tools, bots, or scripts to interact with the Service in a manner that degrades performance or manipulates recommendations
  • Attempt to gain unauthorized access to the Service, other user accounts, or our systems
  • Submit fraudulent votes or otherwise attempt to manipulate the recommendation system
  • Use the Service for any unlawful purpose
  • Interfere with or disrupt the Service or its infrastructure
  • Scrape, crawl, or collect data from the Service without our written consent
  • Reverse engineer, decompile, or disassemble any part of the Service

Our Content

The Service, including its design, code, algorithms, and recommendation models, is the property of Big Dumb Lizard LLC. All rights are reserved.

Magic: The Gathering

Magic: The Gathering is a trademark of Wizards of the Coast LLC. Card names, images, and game mechanics are the property of Wizards of the Coast. Recommander is not affiliated with, endorsed by, or sponsored by Wizards of the Coast.

User Contributions

By submitting votes and other interactions through the Service, you grant us a non-exclusive, royalty-free, perpetual license to use that data to operate and improve the Service, including training and updating our recommendation models.

Donations and Ko-fi

Donations made through Ko-fi are voluntary and non-refundable. Donations may entitle you to certain benefits within the Service, which will be described at the time of donation. We reserve the right to modify or discontinue donation-based benefits at any time, though we will make reasonable efforts to honor existing commitments.

Donations do not constitute a purchase of goods or services and do not create any contractual obligation beyond the benefits described at the time of donation.

Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure. We do not warrant the accuracy, completeness, or usefulness of any deck recommendations.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIG DUMB LIZARD LLC AND ITS OWNER(S) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, USE, OR PROFITS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $50, WHICHEVER IS GREATER.

Indemnification

You agree to indemnify and hold harmless Big Dumb Lizard LLC and its owner(s) from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

API Usage

Access to the Recommander API, if available, is subject to separate terms and rate limits. Unauthorized use of the API, including exceeding rate limits or using the API for commercial purposes without a license, may result in suspension of access.

Changes to Terms

We may update these Terms from time to time. If we make material changes, we will post the updated Terms on this page and update the “Last Updated” date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
